Terms of Service

These terms govern your use of the Pivumo mobile app, provided by NOVEMADE (“we”). By using Pivumo you agree to them. If you do not agree, please do not use the app.

1. Who may use Pivumo

Pivumo is made for young children but is intended to be obtained and set up by a parent or legal guardian. You must be old enough to form a binding contract where you live in order to accept these terms, create an account or buy a subscription. If you set Pivumo up for a child, you are responsible for their use of it.

2. Playing without an account

Pivumo can be used as a guest, with no account and no network connection. Guest progress is stored only on that device. If the app is deleted, or the device is lost or reset, guest progress is lost. We cannot recover it, because we never had a copy.

3. Accounts

An account is optional and exists to back up progress and carry a subscription between devices. You can create one with an email address, with Sign in with Apple, or with Google. Keep your sign-in details secure; you are responsible for activity under your account. We may suspend or end an account that is being used to break these terms or the law.

4. Free and premium content

Pivumo includes a free tier: the Home Town world, 12 activities, one child profile, and progress saved on the device. A premium subscription unlocks the full catalogue of 102 activities across 10 worlds, up to five child profiles, the advanced parent insights, and premium content offline.

5. Subscriptions, billing and the free trial

Prices are shown in US dollars. The price actually charged is the one your store displays for your country and currency at the time of purchase, including any tax.

• New subscribers are offered a 7-day free trial where the store determines they are eligible. Eligibility is decided by the store, not by us.
• Unless cancelled, a subscription renews automatically at the end of each period. The store charges the account on file within 24 hours before the period ends.
• If you cancel during a free trial, you are not charged. Any unused part of a free trial is forfeited when a subscription is purchased.

Cancelling

Manage or cancel a subscription in the account settings of the app store you bought it from, at least 24 hours before the next renewal. Deleting the app or deleting a Pivumo account does not cancel a subscription. We cannot cancel it for you.

Refunds

Purchases are made through the app store, and refunds are handled by the store under its own policies. Write to us at info@novemade.com and we will help where we can, but we cannot issue a refund for a store purchase ourselves.

6. Acceptable use

Do not reverse engineer, decompile or tamper with the app except where that right cannot lawfully be excluded; do not try to reach another family’s data or to circumvent the subscription; do not resell or redistribute the app or its content; and do not use Pivumo unlawfully.

7. Our content

Pivumo, the Pivu character, and the app’s artwork, music, voices, text and software are owned by us or our licensors and are protected by copyright and other laws. You get a personal, non-exclusive, non-transferable, revocable licence to use the app for your family’s own non-commercial use. Some audio in Pivumo is used under Creative Commons licences; those credits appear on the Credits screen in the app’s parent area.

8. What Pivumo is not

Pivumo is a learning game. It is not an educational assessment, a diagnostic tool, a medical or psychological service, or a substitute for professional advice. The progress figures in the parent area describe play activity, nothing more. No particular educational outcome is promised.

9. Availability and changes

We may change, suspend or discontinue any part of Pivumo, including activities and worlds. If we make a material change to the premium content while you are subscribed, you may cancel through your store. We are not liable for interruptions caused by your device, your network, or the app stores.

10. Disclaimer and liability

The app is provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows. To the fullest extent permitted by law, our total liability arising out of or relating to Pivumo is limited to the amount you paid us for it in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under local consumer law that these terms do not affect.

11. Ending these terms

You may stop using Pivumo at any time by deleting the app. We may end your licence if you materially breach these terms. Sections 7, 8 and 10 survive.

12. Governing law

NOVEMADE’s legal entity is being established. Until registration completes, these terms name no governing jurisdiction, because naming one before the entity exists would be a statement we cannot stand behind. Nothing in this section affects the mandatory consumer-protection law that applies where you live, which applies regardless. This page will be updated as soon as the entity is registered.

13. The app stores

These terms are between you and us, not with Apple or Google. They are not responsible for Pivumo or for support of it, and they have no warranty obligation in respect of it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes to these terms

If we change these terms we will update the date at the top of this page. Continuing to use Pivumo after a change means you accept the updated terms.
